Agreement

These Terms of Service ("Terms") govern your access to and use of Everly's website, products, and services (collectively, the "Service"). By accessing or using Everly, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

Service Description

Everly is a wedding invitation builder that allows users to create, customize, and share digital wedding invitations. The Service includes design templates, RSVP management, guest list tools, and invitation hosting features.

User Accounts

To use certain features of the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account and use the Service.

Payment & Refunds

Payment processing for Everly is handled by LemonSqueezy, our Merchant of Record. By making a purchase, you agree to LemonSqueezy's terms and payment processing policies.

Refund Policy: We offer a 7-day money-back guarantee on all purchases. If you request a refund within 7 days of your purchase, your payment will be refunded via your original payment method.

Refund Processing: Refunds are processed within 5-7 business days following your request. Depending on your financial institution, it may take additional time for the funds to appear in your account.

Invitation Deactivation: Upon refund, your invitation link will be immediately deactivated and guests will no longer be able to access it.

User Content

You retain all rights to the content you create using Everly, including text, photos, and design choices ("User Content"). By using the Service, you grant Everly a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute your User Content solely for the purposes of operating and providing the Service.

You represent and warrant that you own or have the necessary rights to all User Content and that your content does not infringe upon any third-party intellectual property rights.

Prohibited Use

You agree not to use the Service for any unlawful purposes or in any way that could damage, disable, overburden, or impair our servers or networks. Prohibited activities include:

  • Harassing, threatening, or abusing other users
  • Uploading viruses, malware, or harmful code
  • Attempting to gain unauthorized access to the Service
  • Reverse engineering or attempting to derive the source code of Everly
  • Using the Service to spam, phish, or distribute false information
  • Violating any applicable laws or regulations

Limitation of Liability

To the maximum extent permitted by law, Everly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of this Agreement shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Ontario for any disputes arising out of these Terms or your use of the Service.
